North Carolina attorney general urges federal crackdown on food delivery fees

May 27, 2026 – Attorney General Jeff Jackson said he is asking the Federal Trade Commission (FTC) to crack down on hidden fees on food and grocery delivery apps.

Jackson joined a bipartisan coalition of attorneys general in a letter supporting FTC action after the agency sought public comment in April on whether new rules are needed for delivery fees.

The group urged the FTC to require platforms to show the total cost upfront and throughout the ordering process, including an explanation of each fee and how it is calculated. They also asked for disclosures when menu prices are marked up from in-store or in-restaurant prices.

The attorneys general noted the growth of online food delivery services in recent years, with the platforms having become essential for some consumers, including older people and those with mobility issues.

The attorneys general also warned some platforms may use customer data to set individualized prices, which could lead some users to pay more based on what companies know about them.

Jackson joins attorneys general from New York, Tennessee, Arizona, Connecticut, Delaware, District of Columbia, Illinois, Maryland, Minnesota, New Jersey, New Mexico, Oregon, Vermont, Virginia and Washington on the letter.
